Insurer advises that collapse of pitch fibre pipe is not accidental damage

Mr & Mrs G's property had a pitch fibre pipe sewer system. Following sewage overflowing from their drains they arranged for their pipes to unblocked by rodding and jetting.

A CCTV survey of the pitch fibre pipes showed that the pipes themselves were severely deformed and collapsed in several areas. The pitch fibre pipes had also de-laminated.

Mr & Mrs G submitted a claim to their Insurers who appointed a claims handler to visit them. The claims handler subsequently (and incorrectly) advised them that they were not covered because their policy did not cover them for general deterioration over a period of time,and wear and tear.

Mr & Mrs G appointed Insco who contacted their Insurer. Their Insurer initially strongly maintained the repudiation of the claim. Insco therefore evoked the formal complaints process with the Insurer and we were, after clearly setting out the position, able to persuade them to accept liability for the claim. Accidental damage to underground services was confirmed.
